In March 2007, the US House of Representatives passed the "Employee Free Choice Act." The EFCA was later defeated in the Senate, but is fully expected to make a comeback after the 2008 Presidential elections. The proposed legislation in the Employee Free Choice Act would have effectively made it legal for unions to organize workers by having a simple majority - 50% +1 of employees - sign authorization cards. This technique, called "card check" was previously legal, but did not require employers to recognize a union until a secret ballot election had been held.
The Employee Free Choice Act also calls for the use of an arbitrator to make binding contract decisions if the company and the union cannot come to an agreement within 90 days. The arbitrator’s decisions would stand for two full years before negotiations could again take place.
Finally, the EFCA demands more stringent penalties for companies - not unions - in the event of a ULP.
As politics shift surrounding the 2008 elections, the Employee Free Choice Act is almost certain to make a comeback. This is dangerous legislation for companies and employees alike, as deception, harassment, and new organizing tactics play a strong role in the card signing process.
Companies need to be aware of the tactics unions are using, from Corporate Campaigns to Neutrality Agreements to organizing by Card Check. Protect employees’ right to a fair, secret ballot election by educating them now about the tactics organizers may take, and how they may lose the right to a democratic election if they do sign a card.
